Who can run a business on the same terms
Polish, EU/EEA and Swiss citizens can run a business on the same terms as Polish citizens. For a third-country national, check the actual document: examples of qualifying bases include permanent residence, EU long-term-resident status, and specified temporary-residence permits, including study or family-reunification bases.
If the basis is different or unknown
A right to work, PESEL or a visa label alone does not prove a right to open a JDG. Verify the exact basis through the official service; if it does not give equal access, consider the form/path permitted for a foreign entrepreneur before CEIDG or KRS.
