Understand this route
The seller is liable for non-conformity for two years from delivery, with a 26-month limitation period (art. 133). During the first year a presumption applies: the defect is taken to have existed from the start and the seller must prove otherwise (art. 135). The old duty to notify within 60 days is gone, abolished by Legislative Decree 170/2021.
What to check
- The delivery date: the two-year guarantee runs from it.
- Whether a year has passed: in the first year the seller must prove conformity.
- Make the claim against the seller, not the manufacturer.
- A receipt or other proof of purchase.
Caveat
Two different dates. At EU level temporary protection runs to 4 March 2028 (Council Decision (EU) 2026/1912). Italian instruments, as at 26 September 2026, are still tied to 4 March 2027, and we found no Italian implementing act for 2028. Check your questura and the Ministry of the Interior before acting.
